APPLICANT’S SUPPLEMENTARY HEADS OF ARGUMENT
The applicant wishes to add the following supplementary short arguments in support
of the application, namely:
1.
The Honourable Court is referred to the fact that section 6 forms part of the founding
provisions in the Constitution 1996 and that this case is in regard to the compliance
with a court order which has at its core the Constitutional obligation in terms of
section 6(4).
2.
Furthermore the fact that the First Respondent is the Premier of the Free State, thus
the most important functionary in the Free State Province and due to his oath as
Premier and his knowledge of the Constitution and consequences as an example for
the rest of the Province, knowledge of the Constitution and respect for court orders,
which is an aspect of the Rule of Law, should be of high standard.
3.
The First Respondent relies on compliance with the Honourable Court’s order of the
7th of November 2013 on his interpretation of the doctrine of separation of powers.
This interpretation is not common cause as is alleged by the First Respondent. The
